Terms and Conditions
Effective date: April 2026
These Terms and Conditions are originally written in Czech, which constitutes the sole legally binding version. This English version is a translation provided for informational purposes only. In the event of any discrepancy or inconsistency between the Czech and English versions, the Czech version shall prevail.
1. About the Platform
MDR Academy is a knowledge platform providing informational and educational content related to EU MDR 2017/745 and the broader medical device regulatory landscape. The platform is operated by:

Karel Boháč operates as a sole trader (fyzická osoba podnikající dle živnostenského zákona) registered in the Czech Trade Licensing Register administered by the Magistrát města Brna. Not registered for VAT.
2. Nature of the Service
MDR Academy provides informational content only. Nothing on this platform constitutes legal advice, regulatory advice, or professional consultancy. Use of this platform does not guarantee any regulatory outcome, CE marking, or MDR certification result. For details, please refer to our Legal Disclaimer.
3. User Accounts
All knowledge content on MDR Academy — categories, resources, and the full knowledge base — is publicly accessible without registration or login.
Accounts are not required for content access. If you request access to forms or MCP services, you may be asked to provide contact details so our team can approve and manage your access manually. Any such information is handled in accordance with our Data Privacy Policy.
Access to forms and MCP services may be revoked if you breach these Terms. See Section 5 for details.
4. Access
MDR Academy operates as an open source knowledge platform. All content is free and publicly accessible — no account, no payment, no registration required.
Forms — form tools embedded on category pages are available on request. To request access, contact us at mrdacademy.eu@gmail.com. Access is granted manually and is personal.
MCP — MCP server access is available on request. When requesting access, you must describe your intended purpose and planned use of the MCP server. Access is granted at MDR Academy's sole discretion and is conditional on the stated purpose being accurate and consistent with these Terms.
Once access is approved, MDR Academy does not impose further restrictions on use beyond those set out in Section 7 (Acceptable Use). You bear full responsibility for any implementation, product, workflow, or service you build using content retrieved via the MCP server. Approval of your request does not constitute MDR Academy's endorsement of your intended use. MDR Academy accepts no liability for outputs, decisions, or products derived from MCP-retrieved content — see Section 9.
If the purpose of your MCP access changes materially from what was described in your original request, contact us before proceeding.
There is no paid tier. No payment is required to use any content on this platform.
5. Access Management and Revocation
Access to forms and the MCP server is personal, non-transferable, and granted at MDR Academy's discretion.
Revocation for breach
MDR Academy may revoke your access if you breach these Terms. Before doing so, we will notify you of the breach and give you a reasonable opportunity to remedy it. An exception applies where the breach is serious, ongoing, or involves misrepresentation of your stated MCP purpose — in such cases access may be suspended immediately pending review.
Data on revocation
When access is revoked, your stored form submission data will be retained for a reasonable period before deletion, in accordance with our Data Privacy Policy. You may request deletion of your form data at any time by contacting mrdacademy.eu@gmail.com.
No right to continued access
There is no commitment to continued availability of form or MCP services. MDR Academy may discontinue these services at any time with reasonable advance notice.
6. Payment and Refunds
MDR Academy does not charge for access to its knowledge content. No payment is required for standard use of the platform.
If any specific service is offered on a paid basis in the future, the applicable terms — including the statutory 14-day right of withdrawal under EU consumer law — will be communicated at the time of purchase. To exercise this right, contact us at mrdacademy.eu@gmail.com within 14 days of the transaction.
7. Acceptable Use
You agree not to:
- Use the platform for any unlawful purpose
- Attempt to gain unauthorised access to any part of the platform or its systems
- Reproduce, resell, or redistribute platform content without prior written permission
- Share any access credentials with third parties
- Use automated tools to scrape or extract content from the platform without explicit permission
This applies to all forms of access — direct browsing, form use, and MCP server access.
8. Intellectual Property
All content on MDR Academy — including articles, guides, knowledge base entries, and AI-assisted content — is the property of MDR Academy or its contributors and is protected by applicable intellectual property law. You may use the content for your own personal, non-commercial purposes. You may not reproduce or distribute it without permission.
Content retrieved via MCP access is subject to the same intellectual property restrictions as content accessed via the website.
9. Limitation of Liability
To the fullest extent permitted by Czech and applicable EU law, MDR Academy and its operators accept no liability for any loss or damage arising from use of or reliance on the platform. This includes any regulatory submission, certification process, or business decision made on the basis of content found here.
This limitation of liability does not apply to damage caused by intentional acts (úmyslné jednání) or gross negligence (hrubá nedbalost) on the part of MDR Academy or its operator. Nothing in these Terms limits or excludes liability that cannot be excluded or restricted under mandatory Czech law, including Section 2898 of the Czech Civil Code (zákon č. 89/2012 Sb.).
In particular, MDR Academy accepts no liability for outputs, integrations, products, or decisions derived from MCP-retrieved content. The operator of any system that connects to MDR Academy's MCP server is solely responsible for how that system uses, applies, or presents the retrieved content.
10. AI Act Compliance
MDR Academy operates in accordance with Regulation (EU) 2024/1689 (the EU AI Act). This section sets out how the Act applies to MDR Academy and what it means for users.
MDR Academy's role
MDR Academy is a deployer of AI systems within the meaning of the AI Act. The AI systems used on this platform are provided by third parties — MDR Academy integrates and deploys them as part of the service. MDR Academy is not a provider of AI models and is not subject to provider obligations under the Act. Provider obligations applicable to the underlying models fall on their respective developers.
Classification
The AI chat feature on MDR Academy is an AI system that interacts directly with natural persons. It does not fall within the high-risk AI categories listed in Annex III of the AI Act. Specifically:
- It does not determine or influence access to educational, employment, or essential services
- It does not make autonomous decisions affecting users' rights or significant interests
- It is informational in nature — all regulatory and business decisions remain with the human user
The AI chat is a limited-risk AI system under the Act.
Transparency
In accordance with Article 50 of the AI Act, MDR Academy discloses how AI is used on the platform. Full transparency information — covering the AI chat, MCP server access, and AI-assisted content authoring — is published on the How AI Participates page.
AI-assisted knowledge base content is disclosed as such on that page, in accordance with Article 50(4) of the AI Act regarding AI-generated text published to inform the public.
MCP users
If you access MDR Academy content via the MCP server and integrate it into your own AI system or agentic workflow, you may be acting as a deployer or provider of an AI system in your own right under the AI Act. MDR Academy's AI Act obligations extend only to the operation of this platform. Compliance with the AI Act in respect of any system you build or operate using MCP-retrieved content is your sole responsibility.
11. Out-of-Court Dispute Resolution
Czech Trade Inspection Authority
MDR Academy is subject to supervision by the Czech Trade Inspection Authority (Česká obchodní inspekce, ČOI) with respect to consumer protection obligations. If you are a consumer and have a complaint that cannot be resolved directly with us, you have the right to initiate out-of-court dispute resolution with ČOI:

This right is provided under Czech Act No. 634/1992 Sb. on Consumer Protection.

12. Changes to These Terms
We may update these Terms and Conditions from time to time. The effective date at the top of this page will reflect the most recent version. Continued use of the platform after changes are posted constitutes acceptance of the updated Terms.
13. Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of the Czech Republic. Any disputes arising from the use of this platform shall be subject to the jurisdiction of the competent courts of the Czech Republic.

14. General Provisions
Severability — If any provision of these Terms is found to be invalid, unlawful, or unenforceable under applicable law, that provision will be limited or severed to the minimum extent necessary. The remaining provisions will continue in full force and effect.
Force majeure — MDR Academy will not be in breach of these Terms or liable for any delay or failure to perform if the delay or failure results from events or circumstances beyond our reasonable control, including technical failures of hosting or third-party services, natural events, or regulatory changes that materially affect the platform's operation.
No waiver — Failure by MDR Academy to enforce any provision of these Terms on any particular occasion does not constitute a waiver of the right to enforce that provision in the future.
